Dispute Settlement: Investor-State (Issues in International Investment Agreements)

This paper examines the main aspects of Investor-State dispute settlement from the perspective of both the investor and the host state. Investors and capital-exporting countries favor these disputes being resolved in accordance with international third party dispute settlement procedures. In contrast, capital-importing countries traditionally maintain that the disputes be resolved in the national courts of the host country.
